Judicial Watch Files FOIA Lawsuit Against DOJ for Details on Garland-Milley Meeting Discussing Trump and “Far-Right Extremism“
Judicial Watch filed a FOIA lawsuit against the U.S. Department of Justice seeking details of a reported meeting between Attorney General Merrick Garland and former Chairman of the Joint Chiefs of Staff General Mark A. Milley[1]. The lawsuit, Judicial Watch Inc. v. U.S. Department of Justice (No. 1:24-cv-03380), was filed after the Justice Department failed to respond to an October 15, 2024, FOIA request[1].
The request sought records and communications regarding a meeting between Garland and Milley concerning:
- President or former President Donald J. Trump
- Domestic Violent Extremism
- Far-right Militia Movements
According to journalist Bob Woodward, Garland and Milley met for lunch at the Department of Justice in early 2021[1]. During this meeting, they reportedly discussed then-former President Trump, and Milley urged Garland to investigate domestic threats and “far-right militia groups”[1][2]. This meeting was described as “highly unusual, if not unprecedented”[1].
General Milley reportedly expressed significant concerns about Trump, describing him as “fascist to the core” and “the most dangerous person to this country”[2][5]. Milley was so alarmed about the potential danger Trump posed, even out of office, that he insisted on meeting with the incoming Attorney General Garland[2].
Judicial Watch President Tom Fitton stated that this reported meeting “further demonstrates the Biden administration was and is at odds with the foundational principles of our constitutional republic”[1]. The organization’s lawsuit aims to uncover details about this meeting and its implications for the Justice Department’s actions regarding domestic extremism and political opponents.
